Indian enforcement is now faster, more coordinated and more personal. The Enforcement Directorate, CBI, SFIO, CCI, DRI/DGGI and SEBI increasingly arrive unannounced, often in parallel, and the exposure frequently attaches to individual officers, not just the balance sheet. Preparedness is the one variable a company still controls on the morning of an unannounced regulatory visit. This document sets out four offerings that build that preparedness and respond when something goes wrong.
Who it is for
The document is written for boards, audit committees, general counsel and the law firms that advise them, and for compliance and finance leaders responsible for a company's readiness.
The four offerings
- Crisis management and regulatory response: a written crisis protocol covering before, during and after an enforcement action, plus role-segregated training tracks for senior management, finance, IT, legal and compliance, and front-office staff. Delivered as simulated sessions and a full organisational crisis simulation, with a customised written policy as the takeaway.
- Internal investigations and digital forensics: counsel-led fact-finding with forensic execution, following a seven-step process from intake and triage to remediation and disclosure. A capability spotlight explains the in-house digital forensics practice: forensic imaging and chain of custody, email and eDiscovery, mobile and chat recovery, deleted-data recovery, metadata and timeline analysis, transaction analytics and cloud collection.
- Anti-bribery and anti-corruption due diligence: a six-step method that goes beyond database screening to test the client's own controls and how money actually moves through distributors, agents, consultants and liaison partners, benchmarked against the PC Act, FCPA, UK Bribery Act and multilateral development bank standards.
- Compliance programme design: a focused three-to-four-week mandate delivering policies and SOPs, ABAC mark-ups of the contract base for counsel to settle, and role-based training.
Case studies
Four illustrative composites show the offerings in practice: a parallel ED and Income-Tax action at a residential developer; kickbacks disguised as offshore engineering fees at a US-listed automotive OEM; an evergreening and collusion ring at an NBFC; and ABAC due diligence for a global fund investing into India. Names, figures and timelines are indicative; no client is identifiable.
How NARADism works with counsel
NARADism is not a law firm. Where privilege matters, the firm asks to be instructed by external counsel and works as counsel's agent: counsel owns the legal strategy and the privilege, NARADism executes the investigation. The document explains how privilege is protected through counsel, and what changes when a company instructs the firm directly.
